INJURED WORKERS' BILL OF RIGHTS
If you are injured on the job or suffer a disease caused by or aggravated by your job, you may have the right to:
1. Tax free temporary Workers’ Compensation benefits;
2. Temporary disability benefits;
3. Free medical care for your work related injury or disease from a doctor chosen by your employer; and if treatment is not provided, an attorney may file a motion for treatment and you will not be charged for these legal services;
4. Partial or total disability for permanent work-related injuries;
5. Continuous or intermittent leave under the Family & Medical Leave Act of up to 3 months if you work in a company with more than 50 workers for more than 12 months;
6. Reasonable accommodation by your employer to your handicap, as long as you can perform the essential functions of your job;
7. Compensation from a party, not your employer or fellow employee, if your accident or illness was caused by the third party;
8. Compensation for exposure to asbestos and to compensation from the employers where you were exposed and from the companies that manufactured, utilized, or distributed asbestos;
9. Protection under your union contract if you are in a union (this is your most important right); and if there is no union, you have the right to join a union without being discriminated against; and
